SSC 10 Marks Rule Hearing in Kolkata High Court

The much-debated SSC 10 Marks Case was heard today in the Kolkata High Court before Justice Amrita Sinha. The hearing, though brief, shed light on crucial points about teacher recruitment and qualification fairness. Senior advocates like Kalyan Banerjee, Minakshi Goswami, and Ashish Babu argued representing different sides in this ongoing legal battle between experienced and newcomer teachers.

At the heart of the case lies the rule granting 10 additional marks to teachers with prior experience in Classes 9 and 10 during recruitment for Classes 11 and 12. The petitioners questioned why long-serving teachers must again give a teaching demonstration. Their lawyers cited a Supreme Court ruling favoring fair opportunity for all educators terminated earlier.

Justice Amrita Sinha clarified that the Supreme Court never mandated any special advantage for dismissed teachers but emphasized transparent and fair recruitment. She remarked that the “rules are rules,” and this 10-mark issue is already under consideration by the Supreme Court. Her observation indicates that the controversy has far-reaching implications for existing and aspiring teachers.

Meanwhile, the WBBSSC’s counsel questioned the maintainability of the petition, highlighting that the candidates appeared for exams knowing all conditions. They argued that it was unjustified to challenge the same rules afterward. After hearing both sides, Justice Sinha scheduled the next detailed hearing for November 12, when related petitions will be addressed together.

The upcoming hearing is expected to decide whether the 10 marks for experience will remain valid. Observers believe a ruling against experienced teachers could cost nearly 60–70% of eligible 2016 candidates their jobs, opening doors for freshers instead. This judgment will be crucial for maintaining balance between merit, experience, and equality in the state’s teacher recruitment process.
